Terms of Service

These Terms of Service ("Terms") govern your use of LoadPR ("the app", "we", "us"), a weightlifting personal record tracker for iOS. By downloading, installing, or using LoadPR, you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use LoadPR on Apple devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms. This license does not grant you any ownership rights in the app.

2. Subscriptions and In-App Purchases

LoadPR offers a free tier and optional paid upgrades, including an auto-renewing subscription (LoadPR+ Annual), a one-time lifetime purchase (LoadPR+ Lifetime), and a one-time "Remove Ads" purchase.

LoadPR, including its name, logo, design, source code, and content provided by us, is owned by the developer and is protected by copyright, trademark, and other intellectual property laws. Apple and the App Store are trademarks of Apple Inc. All other trademarks are the property of their respective owners.

You retain ownership of the fitness data you create in the app. We do not claim any rights to your data. The handling of your data is described in our Privacy Policy.

6. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components.

LoadPR is a fitness tracking tool and is not a medical device. It does not provide medical advice. Consult a qualified professional before beginning, modifying, or discontinuing any exercise program. You assume all risks associated with physical activity.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the app, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the app shall not exceed the amount you paid for the app in the twelve (12) months preceding the claim.

The app uses third-party services, including Google AdMob, Apple CloudKit, and Apple StoreKit. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected in app updates and on this page. Your continued use of the app after changes are posted constitutes your acceptance of the updated Terms.

10. Termination

We may suspend or terminate your license to use the app at any time if you breach these Terms. You may stop using the app at any time by deleting it from your device. Provisions that by their nature should survive termination (including intellectual property, disclaimer of warranties, and limitation of liability) will survive.

11. Governing Law

These Terms are governed by the laws of France, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the competent courts of the same jurisdiction.

12. Acknowledgement (Apple End-User License Agreement)

You acknowledge that these Terms are between you and the developer, not Apple. Apple is not responsible for the app or its content. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.
